1. Acceptance of Terms
Welcome to smilerightbraces.com(the "Site"), operated by SmileRight Braces ("we," "us," "our"). By accessing or using the Site, requesting an appointment, or otherwise interacting with our services, you ("you," "user," "patient") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Site.
These Terms work alongside our Privacy Policy (available at smilerightbraces.com/privacy-policy), which is incorporated by reference. Where our Privacy Policy addresses how we handle your data and these Terms address the rules of using our Site and services, both apply together.
2. Who We Are
SmileRight Braces is an orthodontic practice located at 17375 Tomball Pkwy Ste 2B, Houston, TX 77064.
3. Eligibility & Use of the Site
You must be at least 18 years old to independently use this Site to request appointments or submit information on your own behalf. If you are booking or submitting information on behalf of a minor, you represent that you are the minor's parent or legal guardian and are authorized to provide consent for their care.
You agree to provide accurate, current, and complete information when using our booking system or contact forms, and to update such information as needed.
4. No Medical Advice — Informational Purposes Only
Content on this Site (including descriptions of treatments, pricing, before/after images, blog posts, and FAQs) is provided for general informational purposes only and does not constitute medical or dental advice. It is not a substitute for an in-person evaluation, diagnosis, or treatment plan from a licensed orthodontic provider.
No provider-patient relationship is created by browsing this Site, submitting a contact form, or scheduling an appointment online. That relationship begins only when you are seen and evaluated in person by a licensed provider at our practice.
If you believe you are experiencing a dental or medical emergency, do not rely on this Site — contact your provider directly or call 911.
5. Appointment Scheduling
We use Acuity Scheduling, a third-party platform, to manage online appointment requests. Your use of the scheduling widget is also subject to Acuity's own terms of service, which are separate from these Terms. A request submitted online is a request for an appointment, not a confirmed appointment, until confirmed by our office.
Cancellations and no-shows: Our current cancellation/rescheduling policy is provided at the time of booking and/or posted at our office.
6. Electronic Communications
By providing your email address, phone number, or by using our Site, you consent to receive communications from us electronically, including email, text message (see Section 7), and communications through our patient portal or scheduling system, if applicable. You agree that any notices, disclosures, or other communications we send electronically satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by law.
7. SMS / Text Messaging Terms
Our full SMS opt-in, opt-out, and messaging disclosures are set out in our Privacy Policy, Section 6, and are incorporated here by reference. In summary: message/data rates may apply, message frequency varies, reply STOP to opt out and HELP for help, and consent to receive texts is never a condition of receiving treatment or services from us.
8. User Conduct
You agree not to:
• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of the Site, our booking system, or related systems
• Submit false, misleading, or fraudulent information through our forms or booking system
• Interfere with or disrupt the Site's operation, including through automated scraping, bots, or excessive requests
• Use the Site to transmit any harmful code, virus, or malicious software
9. Reviews, Testimonials & User Content
If we display patient reviews or testimonials (on this Site or on third-party platforms we link to), we obtain separate, specific authorization from the patient before publishing any content that could identify them or their treatment, consistent with HIPAA requirements. Testimonial content reflects individual patient experiences and results, which vary and are not guaranteed for any other patient.
If you submit content to us (e.g., a review, comment, or photo) with permission to publish, you grant us a non-exclusive, royalty-free license to use that content in connection with our marketing, subject to the separate authorization described above.
10. Intellectual Property
All content on this Site — including text, graphics, logos, images, and design — is owned by or licensed to SmileRight Braces and is protected by applicable intellectual property laws. Pricing information displayed on this Site is provided for general reference and is subject to change without notice. Actual treatment costs are determined following an in-person consultation and evaluation. Any financing arrangements are subject to the separate terms of the financing provider and are not guaranteed by SmileRight Braces.
13. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT OR GUARANTEE ANY PARTICULAR TREATMENT OUTCOME.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SmileRight Braces, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION DOES NOT APPLY TO CLAIMS ARISING FROM ACTUAL CLINICAL TREATMENT, WHICH ARE GOVERNED BY SEPARATE INFORMED CONSENT DOCUMENTATION EXECUTED IN OUR OFFICE, NOT BY THESE WEBSITE TERMS. 15. Indemnification
You agree to indemnify and hold harmless SmileRight Braces and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.
16. Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Subject to the arbitration provision in Section 17 below, any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Harris County, TX, Texas, and you consent to the personal jurisdiction of those courts.
17. Dispute Resolution — Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO PARTICIPATE IN A CLASS ACTION.
17.1 Agreement to Arbitrate
Except for disputes that qualify for small claims court (see 17.4) or claims arising from actual in-person clinical treatment (which are addressed separately through informed consent and medical malpractice procedures under Texas law, not this Site), you and SmileRight Braces agree that any dispute, claim, or controversy arising out of or relating to your use of this Site, these Terms, or our Privacy Policy — including disputes about the scope, applicability, or enforceability of this arbitration agreement — will be resolved by binding individual arbitration, and not in court, except as provided below.
17.2 Arbitration Provider and Rules
Arbitration will be administered by American Arbitration Association (AAA) under its AAA Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
17.3 Class Action Waiver
YOU AND SmileRight Braces AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
17.4 Exceptions
Either party may bring an individual action in small claims court instead of arbitration, if the claim qualifies. Either party may also seek injunctive relief in court for claims related to intellectual property or unauthorized access to the Site.
17.5 Right to Opt Out
You may opt out of this arbitration agreement by sending written notice to 17375 Tomball Pkwy Ste 2B within 30 days of the date you first agreed to these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, neither you nor SmileRight Braces will be required to arbitrate disputes with each other, but all other parts of these Terms remain in effect.
18. Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, power or internet outages, or other events of force majeure.
19. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If we make material changes affecting the arbitration provision in Section 17, we will provide notice and, where required, a renewed opportunity to opt out.
20. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. If the class action waiver in Section 17.3 is found unenforceable for a particular dispute, the parties agree that the entirety of Section 17 (arbitration) shall be null and void as to that dispute only, and the dispute shall proceed in court as described in Section 16.
21. Entire Agreement
These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and SmileRight Braces regarding use of the Site, and supersede any prior agreements regarding the Site specifically (this does not apply to separate clinical informed consent documents executed in our office, which remain governed by their own terms).
